Black Nurse Wins £23k After Tribunal Finds Bias in Sleeping on Duty Probe

A Black nurse has won £23,603.45 at an employment tribunal.

The case ruled that a disciplinary investigation was racially discriminatory.

Beatrice Mbonda worked at Quarryfields Care Home.

She was accused of sleeping on night shifts on 9 and 10 March 2023.

Three white staff members made the reports.

The investigation only interviewed white colleagues.

Five Black staff members on the same shifts were not spoken to.

Mbonda denied sleeping.

She said she was in the clinic room with doors closed but unlocked.

She had been listening to music and news on her phone.

She told the investigation the allegations might be racially motivated.

Her concerns were ignored.

Mbonda showed a video of white nurse Angela Briggs asleep on duty in uniform next to a resident.

No action was taken against Briggs.

Mbonda got a final written warning for gross misconduct.

She appealed.

The appeal failed.

She resigned on 9 December.

The tribunal said the investigation was unfair.

It relied only on white staff evidence.

It ignored Black staff.

The judge said the decision-maker had a “closed mind”.

They did not explore racial concerns properly.

Mbonda was awarded £23,603.45.
