A Virginia patient’s secret smartphone recording during a 2013 colonoscopy led to a landmark $500,000 lawsuit victory, exposing egregious unprofessional conduct by his medical team. Recently resurfaced in online discussions, this case serves as a sobering reminder for nurses and healthcare professionals to uphold patient dignity and ethical standards, even in high-pressure settings like the operating room (OR). The incident underscores the profound impact of professionalism—or its absence—on patient trust and institutional reputation.

A Routine Procedure, A Shocking Discovery

In April 2013, a patient identified as “D.B.” visited a medical facility in Reston, Virginia, for a routine colonoscopy. To capture post-operative instructions, he set his smartphone to record but inadvertently left it running during the procedure. Upon waking, D.B. was stunned to hear anesthesiologist Dr. Tiffany Ingham and other staff mocking him with derogatory remarks, including fabricated claims of “tuberculosis of the penis” and syphilis, insults labeling him “a retard,” and plans to falsify his medical chart with nonexistent hemorrhoids. The gastroenterologist, Dr. Soloman Shah, was named in the lawsuit but later dismissed.

The recording fueled a lawsuit against Dr. Ingham and her practice, Aisthesis in Bethesda, Maryland. In June 2015, a Fairfax County Court jury awarded D.B. $500,000 after a three-day trial: $100,000 for defamation ($50,000 for each false disease claim), $200,000 for medical malpractice, and $200,000 in punitive damages to deter such behavior, with Aisthesis liable for $50,000 of the punitive amount. Dr. Ingham resigned following the verdict, a stark consequence of her unprofessional conduct.
